Liability Facts: 15 year old female was walking home
from a friend’s house when she was attacked and
bitten by a dog in the public street. She sustained
numerous bites which broke the skin on her left leg,
right arm, back and buttocks. The dog, an Akita mix,
belonged to the son of a homeowner residing in the
same Cherokee County neighborhood and had been
allowed to run loose and unattended. Animal Control
was summoned to the scene where it took custody of
the dog and cited its owner with county leash law
violations. Plaintiff was taken to the hospital
emergency room where she received stitches and was
admitted overnight for observation and rabies
testing which proved negative. An investigative
canvass of the neighborhood identified another
resident which had been bitten by the same dog 9
months earlier.
