Liability Facts: :56 year old previously medically
disabled man was a passenger in a fishing boat being
operated by his son-in-law late at night on Lake
Allatoona in Cherokee County, Georgia. The two were
trolling at approx. 10-15 mph with the boat’s
navigation lights in operation when a 34 foot
cruising vessel being operated by the Defendant
approached them from the rear at a high rate of
speed. The Defendant’s vessel struck the stern of
the fishing boat, traveling up over its port side,
thereby striking Mr. Gramling in the back of his
head and left rear torso of his body rendering him
unconscious. The Defendant subsequently refused to
voluntarily submit to a state mandated blood/urine
chemical analysis test for alcohol requested by Ga.
Department of Natural Resources.
Injury: Multiple contusions, left shoulder sprain,
aggravation of pre-existing cervical and lumbar
degenerative disc disease.

Medical Expenses: $ 5,164.75
Lost Wages: None, Plaintiff was previously disabled
due to coronary artery disease, a stroke, and severe
arthritis
Settlement: Case settled with State Farm prior to
filing suit for $47,000.00
