Liability
Facts: An automobile collision occured on Friday,
December 10, 1993, at approximately 7:30 P.M. in
Bibb County, Georgia. Mr. Raymond A. Mack, driving a
1987 BMW was traveling southbound on Pio Nono Avenue
inside the City limits of Macon, Georgia. Mr. Mack
had safely stopped his vehicle behind another
vehicle which was getting ready to execute a
lefthand turn. A vehicle being operated by Mr. Kelly
E. Holland was also traveling southbound directly
behind Mr. Mack's vehicle and was unable to stop
before striking the rear of Mr. Mack's vehicle thus
pushing Mr. Mack's vehicle into the rear of the
vehicle immediately ahead of him.
Soon thereafter, Ms. Wendy L. Brown while operating
her vehicle was also following so closely behind Mr.
Holland's vehicle that she too was unable to stop
and thus slammed into the rear of Mr. Holland's
vehicle with such force that his vehicle was thrust
into the rear of Mr. Mack's vehicle a second time.
At the time of this collision Ms. Miriam L. Mack was
a frontseat passenger in her husband's vehicle and
their minor son, Mr. Vincent Mack was a backseat
passenger.
Injury: Ms. Miriam L. Mack and Mr. Vincent Mack
suffered soft tissue injuries. Mr. Raymond A. Mack
suffered herniated discs at C5-6 and at C6-7 and
subsequently underwent an anterior cervical
discectomy and fusion surgical procedure for this
condition.
Medical Expenses: Mr. Raymond A. Mack -
approximately $25,000.00, Ms. Miriam L. Mack and Mr.
Vincent Mack - each incurred approximately $1,500.00
Lost Wages: Mr. Raymond A. Mack $1,600.00
Notes: Jurisdiction for the Defendants would have
been in Bibb County, Georgia. The settlement was
entered into with contributing payments being made
by USAA Insurance Company and Omni Insurance
Company.
Settlement: Mr. Raymond A. Mack $105,000.00, Ms.
Mirian L. Mack $13,000.00 and Mr. Vincent Mack
$7,700.00
